1. Scope
This policy covers the subscription plans Merchants purchase from Higgs Software to use Higgs Menu. Refunds for food or goods that guests order from a Merchant are separate and are described in Section 6.
2. Free Trials
New Merchant accounts may include a free trial. No subscription fee is charged during the trial. If you add a subscription while still on the trial, your free trial continues to its end date and the first charge is taken when the trial ends. If you do not subscribe, the trial simply expires.
3. Subscription Billing
Paid plans are billed in advance on a recurring basis (monthly or annually, as selected). Each charge covers the upcoming billing period. Prices are shown in the app before you subscribe.
4. Cancelling Your Subscription
You can cancel at any time from your billing settings. Cancellation stops future renewals; your plan stays active until the end of the period you have already paid for, after which it will not renew. We do not provide partial refunds for the unused part of a paid period unless required by law.
5. Subscription Refunds
Subscription fees are non-refundable except where required by law. If you believe you were charged in error — for example, a duplicate charge or a charge after a timely cancellation — contact us and we will review it in good faith.
6. Guest Order Refunds
Refunds for food or goods a guest orders are the responsibility of the Merchant, who is the seller. Higgs Software is a technology provider and is not a party to that sale. Where a refund is issued, it is processed through the relevant payment processor (Stripe in Canada, Bonum in Mongolia) and is subject to that processor’s rules and timing.
7. Processing Fees on Refunds
Payment processors may not return their per-transaction processing fee when a payment is refunded or charged back. Any such fee retained by the processor is outside our control.
